The debate about the recording of working hours seems to be new due to the recent discussions, but in reality the Working Hours Act (ArbZG) was already enacted in 1994. This gives employers nationwide regulations to protect employees. It regulates maximum working hours, break times and much more. Until now, however, only overtime and Sunday work had to be documented, not the entire working time.
Ruling on the obligation to record working hours
On September 13, 2022, the German Federal Labor Court (Bundesarbeitsgericht, BAG) ruled to introduce an obligation to systematically record all working time.
The ruling is intended to provide more job protection for employees and protect those who otherwise work a lot of unpaid overtime. The European Court of Justice justifies this with the European Charter of Fundamental Rights and the fundamental right of employees as an important social policy principle.
Back to the time clock?
Young companies in particular resist this ruling, as they feel it restricts their flexibility and agility. It reminds them of the days when time clocks or time cards were used to record working hours. They predict the end of trust-based work, home offices and the New Work lifestyle. However, the fact that modernized work processes are not solely dependent on the recording of working hours is demonstrated at the latest by the example of desk sharing and modern room management.
